Henson Trust

A trust set up for a disabled beneficiary.  Known as a “discretionary trust” in that the discretion is with the trustee and not the beneficiary.  If properly set up, the beneficiary is not disentitled from receiving provincial disability benefits, and can receive funds without them being ‘clawed back.’  See also Registered Disability Savings Plans (RDSPs), which have supplanted Henson Trusts for many people as a way to provide sums of money to a disabled child without impairing their entitlement to disability pensions.
