In Wills and Estates, a document attached to a will listing personal property to be gifted (bequeathed) to certain individuals. To be valid the memorandum must:
- have existed prior to the making of the will;
- must be signed and dated prior to the date on the will; and
- the will must contain clear and specific reference to the memorandum document.
A memorandum to a Will cannot be altered except by a codicil or a new Will.
